fa ریشه‌یابی ناکارآیی‌های ضوابط و مقررات طرح‌های توسعه شهری ایران Discovering the Roots of the Inefficiencies of the Rules and Regulations of Iran's Urban Development Plans جغرافيای شهری Urban Geography پژوهشی اصیل Original Research <div style="border-bottom:solid windowtext 1.0pt; padding:0in 0in 1.0pt 0in">اهداف: انتقادها و پیشنهادهای فراوانی در زمینه قوانین شهرسازی و ضوابط و مقررات طرح‌های توسعه شهری وجود دارد ولی ریشه و زمینه ظهور این‌گونه قواعد که موجب انتقاد شده یا پیشنهاد اصلاح آن مطرح‌شده، روشن نیست و تاکنون به آن پرداخته نشده است. هدف این پژوهش رسیدن به سرچشمه‌های ایجاد مشکلات و ناکارآمدی‌های ضوابط و مقررات طرح‌های توسعه شهری ایران بود. روش‌شناسی: گردآوری داده‌ها به روش پژوهش اسنادی، در قالب کدهای باز مرتبط با انتقادات، ناکارآیی‌ها و پیشنهادها مطرح‌شده در 200 سند نوشتاری بین سال‌های 1379 تا پایان 1400 انجام و بر پایه کدهای منتج از مطالعات اسنادی، مصاحبه‌های ساختاریافته با 18 خبره شهرسازی و 3 خبره حقوق، سازمان‌دهی و کدگذاری محوری، انتخاب کدها و مقوله‌بندی در پیروی از روش پژوهش داده‌بنیاد و به‌کمک نرم‌افزار Access 2016 انجام شد که فرآیند و نتایج پژوهش با مشارکت 5 تن از خبرگان فوق و ارزیابی بر اساس 9 پرسش کرسول تایید شد. یافته‌ها: ریشه ناکارآیی‌های یادشده به ترتیب اهمیت برمی‌گردد به مقوله یا زمینه‌های «دیدمان»، «ساختار و سازمان حکمروایی»، «نظام تدوین و تصویب و اجرا»، «قوانین-ضوابط و مقررات»، «نهاد برنامه‌ریزی» و «مراجع قانون‌گذار» که هرکدام دارای مقوله‌های ریزتر بوده و کدهای محوری آنها به ترتیب «پایگاه نظری»، «نیروی انسانی»، «کاستی نظری»، «نارسایی قوانین فرادست»، «کاستی عناصر نهادی» و «کاستی‌های رویکردی و نظری» بود. نتیجه‌گیری: نتایج پژوهش حاکی از این است که کاستی‌ها و ناکارآیی‌های ضوابط و مقررات طرح‌های توسعه شهری ایران دارای ریشه‌های چندگانه‌ای است و با روشن‌شدن آن، راه برای اصلاح آنها باز می‌شود. محور شش زمینه برسازنده به ترتیب «گذار پارادایمی»؛ «سیاسی‌کاری و عدم همکاری و هماهنگی»؛ «مشارکت»؛ «ماهیت میان‌رشته‌ای قوانین شهرسازی»؛ «ناهماهنگی عناصر» و «ناهماهنگی دیدگاهی و رویکردی» است که به‌کمک «نارسایی در واژگان و نبود زبان مشترک» زمینه‌ساز ناکاری‌ها شده است.</div> <div style="text-align: justify;"></div> Aims: There are many criticisms and suggestions in the field of urban planning laws and rules and regulations of urban development plans, but the roots and context of the emergence of such rules that have been criticized or proposed to amend them are not clear and have not been addressed. The purpose of this study was to reach the sources of problems and inefficiencies in the rules and regulations of Iran's urban development plans. Methodology: Data collection was done by documentary research method, in the form of open codes related to criticisms, inefficiencies, and suggestions presented in 200 written documents between 2000 and the end of 1400. Axial organization and coding, code selection, and categorization were performed following the data-based research method and with the help of Access 2016 software. The research process and results were confirmed with the participation of 5 experts and evaluation based on 9 Cresol questions. Findings: The study showed that the roots of the mentioned inefficiencies go back to the category or fields of vision, governance structure and organization, a system of formulation and approval, rules-rules and regulations, planning institutions, and  Legislative authorities each of which has smaller categories and their central codes are theoretical base, manpower, theoretical shortcomings, the inadequacy of supreme laws, shortcomings of institutional elements and approach and theoretical shortcomings, respectively. Conclusion: The results of this study indicate that the shortcomings and inefficiencies of the rules and regulations of Iran's urban development plans have multiple roots that, when clarified, pave the way for their correction.
